The following terms and conditions are the rules followed by all MEMBERS at The Song Warehouse. Please read thoroughly, so you understand how our system works in order to provide a clear and concise working relationship, based on mutual respect.
I. WHAT WE DO
1. The Song Warehouse is a place to market original songs to our MEMBERS looking to “license for use” original music for their business projects and musical needs. Our focus is marketing music by bringing songwriters and music industry professionals, artists, businesses and others together who are in the market for original music for use on projects, record deals, movies, commercials, artist and band performances, and personal development in order to perform the songs in public and use music for various means of performance and promotion as necessary. Any and all manner in which original music is needed to license, perform, develop and sell; The Song Warehouse is a song marketing business designed to bring the parties together.
II. OUR POSITION
2. The Song Warehouse cannot guarantee a songwriter’s music will be licensed or listened to by any of our MEMBERS. Our position is to market the site to outside sources of this particular business industry and bring the parties together. Through marketing our business, we hope those we market to become members in order to have the privilege to shop at our warehouse of music for the purpose of finding songs they can license for their particular business need. The Song Warehouse expects the songwriters to upload songs properly, with correct descriptive genre directed terms, that will bring listening MEMBERS to their music. The Song Warehouse cannot promise one of your songs will be chosen to be used or licensed by any of our music industry or business members. We do promise to work hard to connect our service to others through research, grassroots, social media, campaigns, advertisements, and various other marketing programs to bring songwriters and businesses together.
III. OUR COMMITMENT
3. The Song Warehouse cannot prove to our members anything, other than our guarantee to spend our time growing our business to become a mustard tree of artists, musicians, music industry, businesses, bands, music supervisors, record labels, A&R reps, and the like coming to hang out in our branches, and fellowship to develop working relationships that will blossom into partnerships and success.
The Song Warehouse equally cannot guarantee to the music industry or any of our business members we will have in our warehouse the particular genre of song you need at any given time. This business will always be in motion, with our goal to bring new music in our doors on a regular basis. All members must realize our warehouse has revolving doors of music coming in and going out. The Song Warehouse will be continually working to build our catalog of songs to shop at the warehouse and bring in the music industry and businesses who need music at regular intervals.
IV. OUR PLANS
4. All MEMBERS to this site must understand as a songwriter member, music industry professional member, or business professional member, the Plan you choose is non-refundable. When you purchase any of our Plans, you will not be refunded for the period of time you purchased, whether you want to cancel early or not. You will not be refunded, if you decide you no longer want to use our services. However, we will work hard for that not to be the case. You will not be refunded for any reason, because the service you are paying for is the marketing to bring the parties together. Once you have entered the warehouse, or uploaded your songs to be heard, you have used our services for the intended purpose. By keeping the cost to run this site efficient; we are able to keep our prices fair. One good contact connection is well worth what you pay at The Song Warehouse.
V. OFFERS AND PROMOTIONS
5. The Song Warehouse reserves the right to offer promotional discounts; and to raise or lower our prices when we see fit. Any member who is currently in a Plan will not be allowed to get the promotional rate, or any promotions, until their Plan expires. There may or may not be a promotional Plan going on when your Plan expires. It’s all about timing. At the same time, if the prices are raised, any member currently on a Plan will not be affected, until their current Plan expires.
VI. LEGAL DISPUTES
6. The Song Warehouse is not responsible for any legal disputes or otherwise any members who enter into our Membership Plans make through record deals, signing contracts or license for use agreements, or any type of agreement of any kind, made through this site. The Song Warehouse is not an arbitrator with any members who develop business working relationships with each other through our warehouse. Unless we have entered into a Publishing Agreement with any songwriters who join here, we are not involved, nor responsible legally for any problems or legal matters or issues that may arise amongst MEMBERS from this site. All members of this site, will be responsible for their own legal issues, and to hire their own attorney’s necessary, concerning any relationship problem between MEMBERS of any kind, no matter what, that occur through meeting at The Song Warehouse. Any and all members who engage in legal disputes with each other, will handle their legal disputes outside the confines of The Song Warehouse.
If, in the event, one of our MEMBERS has a question or needs something from us, concerning their legal situation, any MEMBER may contact us, and we will do our part to provide honest information, if found necessary to do so. No promises will be made to any MEMBERS of our decision to involve ourselves in any legal wranglings concerning contractual disputes and agreements made between our MEMBERS.
VII. ARBITRATION
7. Since The Song Warehouse is a warehouse that houses original music through purchasing a Plan for a given period of time for the purpose of marketing and promoting original music. Our services offered are simple. We do not foresee any type of legal problems whatsoever with our MEMBERS; however, in the event, any member from this site desires to enter into dispute with The Song Warehouse. All MEMBERS who join this site and purchase a Plan, agree all disputes will be determined by a panel of Judges through arbitration ONLY in which The Song Warehouse will appoint, a time and designation of their choice, agreed upon within reason by all parties. There are no exceptions to this rule. The Song Warehouse is a fair and peaceful organization, and does not expect any issues to arise, as all issues are covered in the Terms and Conditions of this Agreement.
VIII. HOW THE SONG WAREHOUSE WORKS FOR SONGWRITERS
8. All Songwriters understand if they license one or more of their songs for use, while under a Plan at this site, and the Plan has not expired. The Songwriter is responsible to place the song, or songs into “inactive mode,” until the expiration of the Plan they purchased. The Songwriter understands the songs they uploaded for any particular Plan will be released and removed from this site when the Plan they purchased has expired and not before the expiration date. The Song Warehouse does this for one reason only, and that is to keep the cost of running the site to a minimal.
However, the Songwriter understands their material can be placed into “inactive mode,” at any time during the period of time their Plan is active. The Songwriter understands when a song is placed into “inactive mode,” the song will not be available to either listen to, or on display for others to see. The Songwriter understands they can only remove their songs when the Plan they purchased has expired, but they may place any song or songs into “inactive mode,” at any time during the active period of their Plan. The Songwriter understands if they have more songs they want to promote through this site, they may purchase as many Plans as they like. All Plans follow the same rules, no matter the number of Plans any Songwriter member holds at any given time.
The Songwriter understands if they choose to place any songs they have written into “inactive mode,” they cannot upload another song to replace it, but they can market, promote, play, do whatever they wish with the song or songs placed into “inactive mode” on this site. Even though the song is stored at The Song Warehouse until their Plan has expired. The songwriter understands they are free to use their own songs any way they wish. If the songwriter does not want a song they uploaded to be heard by others at the site, simply place it into “inactive mode,” and no one will see or hear it.
The Music and Business Industry understand any Plan they purchase for any given period of time, will not expire until the period of time designated by the Plan they purchase. The music and business industry understand the Plan they purchase is non-refundable, no matter whether they find the song or songs they want in the early stages of their membership or not. However, if a Music or Business Industry professional contacts The Song Warehouse and states they would like to cancel their membership, they may do so, but will not be refunded for the remainder months, and will lose access to the warehouse, once canceled.
IX. ABUSE OF A PLAN PURCHASED
9. All songwriter, music industry and business industry MEMBERS understand they cannot transfer their Plans to another person, and if found to do so, their Plan will be canceled effective immediately, and they will lose access to use the warehouse. This is a private respectful membership site, and we are building a community of respectable writers, and business members. Please do not abuse the privileges of our services. We work hard, and if others want to join as MEMBERS, they may do so, just as you did, and everyone is blessed. We are building a mustard seed tree of respectable artists, music and business industry professionals, and that is the attitude of this site.
X. TREATMENT OF OUR SONGWRITER MEMBERS
10. The Music Industry or Business Industry is responsible to conduct business with our songwriter members in a fair manner. All contracts, Record Deals, and License for Use agreements must be forthright and explained carefully to our songwriter members, so they understand fully the terms of the agreement you make with them from meeting at this site BEFORE signing contracts. While The Song Warehouse does not involve itself in the business contractual dealings of its members. The Song Warehouse will not fail to reject and block members who are found to do business in an illegal and unfair fashion; a manner found to be against fair business practices to its songwriter members. The Song Warehouse is here to protect the copyrights and interrelational aspects involved in protecting original musical compositions of our songwriters. That is why our warehouse is private and all MEMBERS personal information for contact purposes is private and protected.
XI. TREATMENT OF ALL MEMBERS
11. The Song Warehouse expects all MEMBERS to conduct their business here in a professional manner. Keeping good records, open and forthright communication and promises made concerning the license and use of songs, must be handled with common sense and sound judgement. Use careful and kind consideration in all that you do. Be honest with your intended use of music, and make sure all parties have a clear and concise understanding of what your intended goal for the Songwriter’s music is. Respect, kindness, are the rules for all contact of our MEMBERS with each other.
XII. MUSIC AND MEMBERS THAT WILL BE REJECTED
12. The Song Warehouse will not tolerate any claims of sexual abuse, vulgar language, deceptive practices, or any such perverted agendas of any kind. The Song Warehouse does not accept original music with messages that are evil, intended to seduce, filled with vulgarity, violence, sexual descriptions that are nasty, abusive and offensive in language, promoting any forms of child pornography or prostitution. The Song Warehouse reserves the right to reject any music they find offensive, evil, nasty, seductive, demonic, foul and abusive in language and description, rude, intolerant angry and suggestive to the listener in a way that provokes bad behavior. The Song Warehouse reserves the right to state any descriptive language not listed here, but foul and evil in nature, will be included in music we will reject without question. Back to Top of Page
